Dish Network Cold-Cocked for Cold Calls

Brief scrutiny of today's headlines.
There’s a slugfest developing between the Federal Trade Commission and Dish Network (DISH).
The FTC charges that Dish Network made phone calls to thousands of people listed on the national Do Not Call Registry. Calling people who have opted out of telephone solicitations can result in fines up to $16,000 per violation.
Dish told The Associated Press that it had followed the law. It therefore refused to settle the case and the FTC filed a lawsuit. This is the first time the federal agency has failed to reach an out-of-court settlement with a company that allegedly violated the Do Not Call law.
The Do Not Call Registry was set up in 2003. Since then, the FTC has brought cases against about 40 companies, including Dish Network competitor Direct TV (DTV), which paid about $5.3 million to settle its case.
It’s hard to imagine the FTC not having the numerous complaints it says prompted the legal action in hand. The case, therefore, may turn on a narrow definition of the law that keeps shysters employed.
